LAW and WAR: Its Overlawyered

From Instapundit comes this link. Its an op-ed by Professor Glenn Sumasy who instructs international law at the US Coast Gaurd Academy. Agreeing with Instapundit (Glenn Reynolds, also a lawyer) Sumasy generally asserts fight against our enemies is currently “overlawyered”.

Sumasy points to the Haditha incident where Marines were accused of murdering civilians-thanks largely to the treasonouis bloviating by John Murtha. The Haditha case is quickly unraveling and its becoming more apparent that the Marines did nothing wraong at all. And almost like the Duke Hoax were innocent.

I recall a widely circulated story that at the beginning of our operations in Afghanistan, Mullah Omar’s convoy had been spotted by intelligence sources, but a JAG turned down the commanders desire to attack. After finding out, Don Rumsfeld was fit to be tied.
